As noted in §3.10 above, noncontractual indemnity refers to indemnity between “joint tort-feasors.” Section 537.060, RSMo 2000. The benefits of a release from noncontractual indemnity—a bar against cross claims, third-party claims, and the like—do not inure to persons who are not joint or concurrent tortfeasors. It follows that settling tortfeasors should be careful to ascertain their status as joint tortfeasors.
