A. (§3.1) Generally

A condition is a fact, the existence of which modifies a promise or promises. It therefore creates no rights or duties but limits the undertaking of a promisor to perform. 13 Richard A. Lord, Williston on Contracts § 38:1 (4^th ed. 2000). Parties to a contract are generally free to impose whatever conditions they choose as long as they do not violate public policy. John T.
