I. (§3.1) Generally

Burden of proof has two distinct and separate components. The first component of burden of proof is the burden of production—that is, the burden of producing evidence to make a prima facie case. The other component of burden of proof is the burden of persuasion—that is, the burden of establishing the truth of a proposition or issue by the quantum of evidence that the law demands in the case.
