An owner who has owned and occupied, for less than 180 days, a dwelling to be acquired, or a tenant, either of whom has actually occupied the dwelling to be acquired for at least 90 days before the initiation of negotiations for the acquisition of the dwelling, is entitled to receive an amount necessary to enable the tenant to lease or rent for a period of up to 42 months a decent, safe, and sanitary dwelling, not to exceed $5,250. 49 C.F.R. § 24.402(a) and (b).
