An employee who leaves employment to serve in the armed forces is normally entitled to reinstatement. This right was originally granted under the Veterans’ Reemployment Rights Act (VRR Act), 38 U.S.C. §§ 2021–2027. In 1994, Congress replaced the VRR Act with the Uniformed Services Employment and Reemployment Rights Act of 1994 (VRR Law), 38 U.S.C. §§ 4301, et seq. Congress enacted the VRR Law to clarify the VRR Act and to continue to provide reemployment and prohibit discrimination caused by military service. Gummo v. Village of Depew, N.Y., 75 F.3d 98, 105 (2nd Cir. 1996).
