IV. (§29.19) Support and Maintenance—Marvin Revisited

On remand in Marvin v. Marvin, 557 P.2d 106 (Cal. banc 1976), the trial court found evidence that the parties did not enter into the express agreement alleged by the plaintiff in her pleadings. The court also found that:

the defendant did not have an obligation to pay maintenance to the plaintiff;

the plaintiff had suffered no damage, and in fact had benefited socially and financially, in her relationship with the defendant;

no confidential or fiduciary relationship existed between the parties; and

the defendant had not committed wrongful acts and was...
