D. (§28.10) Standing—Who May Bring the Action

The MoUPA specifies who has standing to bring an action under its provisions. The standing varies depending on what determination the action is seeking. An action to establish the existence or nonexistence of a presumed father-child relationship under § 210.822.1, RSMo 2000, may be brought at any time by:

· the child;

· the child’s natural mother;

· the child’s presumed father under § 210.822.1;

· a man alleging himself to be the father;

· any person having physical or legal custody of the child for more than 60 days; or

· the FSD.

Section 210.826.1, RSMo Supp. 2011. With respect to a child who has no presumed father, an action to determine the existence of a father-child relationship may be brought by:

· the child;

· the mother or the person who has legal custody of the child;

· any person having physical of legal custody of the child for more than 60 days;

· the FSD;
