In Fohn v. Title Insurance Corp. of St. Louis, 529 S.W.2d 1, 5 (Mo. banc 1975), the insured was permitted to recover attorney fees incurred not only in the action against the company on the policy but also those incurred in defending the title to the property in question (a duty that was to have been performed by the insurer but that it failed to do).
