B. (§27.6) Motion for New Trial

Before the judgment and sentence is rendered by the court under Rule 29.07(b), the defendant has the right to file a motion for a new trial, which may be granted upon good cause. Rule 29.11(a). The motion for new trial must be filed within 15 days after the return of the verdict. One extension of 10 days may be granted the defendant for good cause if the defendant requests an extension within the original 15 days. Rule 29.11(b). If the defendant files the motion for new trial and it is denied by the court, or if it is denied by the passage of time, which occurs if the court fails to rule on the motion within 90 days of its filing, the court is to render judgment and sentence against the defendant without an unreasonable delay.
