VIII. (§27.34) Marriage

Missouri courts have long recognized that marriages that are valid where celebrated will be upheld in Missouri even though the marriage might be invalid under Missouri law if contracted in Missouri. See:

· Banks v. Galbraith, 51 S.W. 105 (Mo. 1899)

· Henderson v. Ressor, 178 S.W. 175 (Mo. banc 1915)

· Doyle v. Doyle, 497 S.W.2d 846 (Mo. App. W.D. 1973)

But common-law marriage is an exception to the rule. Missouri courts will not recognize a strictly common-law marriage of Missouri...
