F. (§27.23) Concurrent or Consecutive Sentences

Rule 29.09 and § 558.026.1, RSMo 2000, give the court discretion to decide if multiple sentences of imprisonment are to run concurrently or consecutively. If the court fails to state either concurrently or consecutively in its judgment, the sentences run concurrently. But if the defendant’s multiple sentences are imposed for rape, forcible rape, sodomy, forcible sodomy, or an attempt to commit any of these offenses or for other offenses committed during or at the same time as these offenses, the sentences imposed “for the other offenses may run concurrently, but the sentence of imprisonment for the felony...
