1. (§26.4) Pleading
The initial pleading in a modification matter is usually titled “motion to modify.” Phoning the court clerk to discuss the local rule or practice in the county and to discover all filing requirements is wise. Obviously, the motion to modify must allege sufficient facts to state a cause of action for modification under the applicable statute. Kipper v. Vokolek, 546 S.W.2d 521 (Mo. App. S.D. 1977).
