8. (§26.33) Habeas Corpus

A writ of habeas corpus may be used to effect a change of custody in certain very limited situations. The writ may not be used to alter custodial arrangements when another adjudicatory form is available. In re Cook, 691 S.W.2d 243 (Mo. banc 1985). Thus, when custody is established by a Missouri dissolution decree or other order of a court with competent jurisdiction, a motion to modify, rather than a writ of habeas corpus, must be used to modify custody.
