C. (§26.20) Maintenance in Gross a/k/a Lump Sum Maintenance
In Cates v. Cates, 819 S.W.2d 731 (Mo. banc 1991), the trial court had awarded maintenance in gross to the wife in the amount of $7,800, payable at $325 per month. The Supreme Court held that monthly maintenance payments not yet due and payable, such as those awarded in Cates, are future payments of maintenance subject to termination under § 452.370.2, RSMo, now § 452.370.3, RSMo 2000.
