Section 26 Joint and Several Liability

Section 537.067, RSMo Supp. 2011, provides that the liability of a particular defendant for payment of a judgment is only several unless that defendant is found to be more than 51% at fault. If a defendant is less than 51% at fault, the defendant is only responsible:

for the percentage of the judgment for which the defendant is determined to be responsible by the trier of fact; except that, a party is responsible for the fault of another defendant or for payment of the proportionate share of another...
