3. (§25.20) Determination of Controlling Child Support Order

In the transition from the multiple-support order world created by URESA to the “one-order-at-a-time” world envisioned by UIFSA, the question arose about how to identify one viable order that would be entitled to enforcement in every UIFSA state from many possible orders covering the same parties and child. Section 454.871, RSMo Supp. 2011, sets forth the rules a tribunal is to follow to determine the controlling child support order:

1. If only one child support order exists, that order is the controlling order, regardless of where or when it was issued and whether any of the parties continue to reside in the issuing state. Section 454.871(a); UIFSA 1996 § 207 cmt.
