Section 24 Rights in Traffic

Under the police power, the state has the right to control traffic, and landowners have no rights in traffic that may diverted from their property. State ex rel. State Highway Comm’n v. Meier, 388 S.W.2d 855 (Mo. banc 1965). The only right a landowner has to a public roadway is the right of reasonable ingress and egress to and from the landowner’s property and the abutting highway, which includes the right of reasonable access to reach the general system of roads. Id. But this right is subject to the police power of the state in protecting the public and facilitating traffic. Furthermore, this right does not include the right to travel in any particular direction or on any particular point in the highway or to be protected from the diversion of traffic away from a party’s property.
