In the Revised Code, several regulatory provisions that had been codified in Chapter 577, RSMo, Public Safety Offenses, were moved to Chapter 302, RSMo, Drivers ’ and Commercial Drivers ’ Licenses, and criminal provisions once codified in C hapters 302 – 306 , RSMo, were moved to Chapter 577 , RSMo . For instance, provisions related to the driver ’ s license revocation proceedings for refusal to submit to a chemical test were moved to a new § 302.574 from § 577.041 (amended). See Table 4.1 below for a list of other transferred sections. Not every criminal provision was retained in Chapter 577. For instance, subsection 12 of § 302.574 (new) contains the class A misdemeanor of failure to maintain proof with the Missouri DOR ( Department of Revenue ) , which was moved from § 577.041 (amended). Also, the offense of refusal to furnish records of disposition was moved from § 577.051 to § 302.592.

Also, a provision in §302.304 (amended) requires the DOR to reinstate a person’s driver’s license after two yea rs from a suspension or revocation issued under Chapter 302, even if t he person does not pay the reinstatement fee. The Revised Code modified that provision to exempt suspensions and rev ocations for intoxication-related offenses that previously had been co dified in Chapter 577 but were moved to Chapter 30 2 during the revision process, so the automatic reinstatement provision does not apply to those revocations and suspensions.
