G. (§24.9) Contempt

In In re Marriage of Yonker, 423 S.W.3d 848 (Mo. App. S.D. 2014), the court, upholding the trial court’s order of contempt, held that a person who is able to comply with a dissolution judgment and either refuses to do so or willfully places himself or herself in a position of inability to pay is in contempt of court. The court, reversing the trial court, held that a commitment order should not issue unless there is substantial evidence showing the contemnor was able to purge the contempt. Id.

Rule 67.03 provides that a defendant may move for an involuntary dismissal of the civil action for the plaintiff’s failure to comply with “any order of the court” or for lack of jurisdiction, prematurity of action, or failure to substitute a party for a decedent.
