B. (§24.27) Violation of Custody Order—Visitation and Temporary Custody—Motion to Modify

Section 452.400.1(1), RSMo Supp. 2011, provides that a noncustodial parent “is entitled to reasonable visitation rights unless the court finds, after a hearing, that visitation would endanger the child’s physical health or impair his or her emotional development.”

In 1998, the legislature expanded the definition of who can be found in noncompliance with a visitation or custody order to include not only the custodial parent and the child but also the noncustodial parent or a third party:
