Before a petition is filed, counsel is waived by failing to either retain or request counsel. After a petition is filed, counsel may be waived by the juvenile only with the court’s approval. Rule 115.01.b; § 211.211.8, RSMo 2000. The waiver may be withdrawn at any stage, in which case the court is to appoint counsel, if required. Rule 115.01.c; § 211.211.9. Even if the juvenile expresses the desire to waive counsel, the court may appoint one if it deems that counsel is necessary to ensure a full and fair hearing. Rule 115.01.a; § 211.211.3.
