2. (§23.51) Trustees
The trustee who commits a breach of trust is liable to the affected beneficiaries for (1) the amount required to restore the value of the trust property and trust distributions to what they would have been had the breach not occurred or (2) the profit the trustee made, whichever is greater. Section 456.10-1002.1, RSMo Supp. 2008. If more than one trustee commits a breach of trust, the trustees are jointly and severally liable, unless one trustee was substantially more at fault than the other trustee...
