1. (§23.45) Personal Representatives

Section 473.140, RSMo 2000, governs the removal of a personal representative. A personal representative may be removed upon the court’s own motion, or upon a complaint in writing by an interested person supported by an affidavit, after notice and a hearing. Id. Grounds for removal of the personal representative include:

· mental incapacity;

· habitual drunkenness;
