The cease and desist order may further require the respondent to take any of the following actions to implement the purpose of the Missouri Human Rights Act (MHRA), Chapter 213, RSMo:
1. Payment of backpay—actual and compensatory
A cease and desist order can order an employer to pay backpay to, hire, reinstate, or upgrade an employee. Section 213.075.11(1), RSMo 2000; State ex rel. Martin-Erb v. Mo. Comm’n on Human Rights, 77 S.W.3d 600, 604 n.3 (Mo. banc 2002). The order can also include actual damages, which includes damages for depriving civil rights, emotional distress, and humiliation.
