Section 22 Burden of Proof

The claimant has the burden of proof to establish the presence of a medically determinable impairment, Bowen v. Yuckert, 482 U.S. 137 (1987), as well as the nature and severity of those impairments, 20 C.F.R. §§ 404.1512(a) and 416.912(a). The claimant also has the burden of proof to submit medical and other evidence, 20 C.F.R. §§ 404.1516 and 416.916.
