1. (§22.20) Degree of Causation

The Jones Act expands the negligence concept by minimizing the degree of causation necessary to make a case. As discussed in §22.4 above, in CSX Transp., Inc. v. McBride, 131 S. Ct. 2630 (2011), which is applicable to the Jones Act, the U.S. Supreme Court fully endorsed the relaxed causation standard in that an employer ship owner is liable if its negligence played any part, "no matter how small," in bringing about the employee’s injury.
