3. (§22.19) Death
Before the passage of the Jones Act, general maritime law afforded no remedy when the injury resulted in death. By its adoption of the provisions of FELA, the Jones Act provides such a remedy for seamen. As with FELA, an action to recover damages for negligence causing the death of a seaman may be instituted against the employer by the personal representative of the deceased.
