Section 21 Prior and Persistent Offenders

As a result of the change in the way prior and persistent offenders are punished under the Revised Code, the enhanced penalties for several drug-related crimes are reduced by
one level of felony.
The Original Code requires that a prior drug offender, meaning a person who has previously been found guilty of a felony crime relating to controlled substances, §195.275 ransferred to §579.170), serve sentences at the following penalty levels when found guilty of an additional crime:
· Found guilty of possessing any amount of a controlled substance except 35 grams or less of marijuana or synthetic cannabinoid, a class B felony, §195.285 (repealed Jan. 1, 2017)
· Found guilty of manufacturing or delivering any amount of a controlled substance except 5 grams or less of marijuana, a class A felony, §195.291 (repealed Jan. 1, 2017)
· Found guilty of unlawful distribution to a minor or unlawful transport with a minor, a class A felony without possibility for parole, §195.292 (repealed Jan.1, 2017)
