The cease-and-desist order may further require the respondent to take any of the following actions to implement the purpose of the Missouri Human Rights Act (MHRA), Chapter 213, RSMo:

1. Payment of backpay—actual and compensatory

Backpay is defined as actual damages. See Biggs v. Mo. Comm’n on Human Rights, 830 S.W.2d 512, 516 (Mo. App. E.D. 1992); Joplin v. Mo. Comm’n on Human Rights,
642 S.W.2d 370, 374–75 (Mo. App. S.D. 1982); Johnson v. Hale, 940 F.2d 1192, 1193 (9^th Cir. 1991) (“Compensatory damages may be awarded for humiliation and emotional distress established by testimony or inferred from the circumstances.”); see also Mo. Comm’n on Human Rights v. Red Dragon Rest., Inc., 991 S.W.2d 161, 172 (Mo. App. W.D. 1999) (so called “out-of-pocket” expenses for plaintiff’s lost work time is not an expense that is statutorily authorized).
