Section 21 Jurisdiction

The term “jurisdiction” includes three kinds of authority:

1. Over the subject matter

2. Over the person

3. To order relief

Scott County Reorganized R‑6 Sch. Dist. v. Mo. Comm’n on Human Rights, 872 S.W.2d 892 (Mo. App. S.D. 1994). Jurisdiction, authority, and power are terms used interchangeably for all three issues.

The jurisdiction of the AHC (Administrative Hearing Commission) is different from that of a state agency’s internal hearing officer in three important ways:

The AHC is outside all agencies whose matters it decides.

The agency head has no choice over what matters go to the AHC.
