A negotiable instrument can be enforced, typically by seeking payment against the maker or drawer, only by:

• a person who is the holder of the instrument

• “a nonholder in possession of the instrument who has the rights of a holder”; or

• a person not in possession of the instrument who is entitled to enforce a lost, destroyed, or stolen instrument under § 400.3-309, RSMo 2000, or an instrument paid or accepted by mistake under § 400.3-418, RSMo 2000
