B. (§21.4) Statutory

Within constitutional limits, a state may regulate the qualifications of jurors. Strauder v. W. Va., 100 U.S. 303 (1879). Missouri statutes are designed to ensure a random sample of qualified venirepersons for every trial—thereby providing the parties with an opportunity to select a jury that represents a fair cross-section of the community. While a defendant must show the intentional systematic exclusion of women or minorities to prevail on a constitutional challenge to the jury selection process, § 494.465, RSMo 2000, actually provides greater protection.
