IV. (§21.19) Dealing With the Opposing Expert Witness

Once counsel has obtained through discovery the name of the opposing side’s experts, counsel should learn everything possible about the expert. If there are plans to depose the expert, counsel should have consulted counsel’s own expert for trial or at least for preparing for the deposition. At trial, counsel will want to have the client’s expert nearby to assist in cross-examination of the opposing expert.
