III. (§21.18) How to Find an Expert

Counsel who is seeking an expert to testify on a client’s behalf should examine the expert as if counsel was on trial. The most important consideration is whether counsel and the client can work with the expert. Other important factors include the expert’s:

· ability to clearly communicate difficult concepts—e.g., “assist the trier of fact”;

· lack of bias;

· reputation for producing reliable and timely work product; and

· personality in general.

Unless the area of expertise desired is a very specialized one, such as paternity testing, there will be a number of experts from whom to choose.
