Once the juvenile court dismisses the petition to allow prosecution under the general law, the juvenile court is required to send a copy of the petition and dismissal order to the prosecuting attorney. Section 211.071.8, RSMo Supp. 2010; Rule 129.04.d. It is the prosecuting attorney’s office that must then determine whether to pursue the charges. The juvenile court’s jurisdiction over the juvenile is terminated. From that point forward, with the exceptions noted in §14.5 above, the juvenile should be treated as an adult for prosecution purposes.
