When the time for written comment or the hearing is over, the agency is given a maximum of 90 days in which to reach a final decision on the text of the rule and file its order of rulemaking (“the order”) with the Secretary of State’s office. The agency will normally draft an order of rulemaking to either put the proposed rulemaking into effect as originally proposed, make changes in accordance with the comments received, or withdraw the proposal.
