1. (§20.9) Generally

When the personal representative asserts an interest in property that is adverse to the interest of the estate and the estate’s creditors, heirs, and beneficiaries, the probate court may remove the personal representative. The party seeking removal must make application for removal, asserting the conflict of interest.
