Section 2 Scope of Chapter

This chapter concerns legal claims arising out of acts of violence or threats of violence committed by or against employees in the workplace, on working time, or bearing some other connection to work. It is not limited to seemingly random or personally motivated violence but includes violence that may be viewed as closely related to the employee’s work duties, such as, for example, that engaged in by a security guard or bouncer. The concept of workplace violence covered in this chapter includes employees as perpetrators as well as victims. Many of the same legal considerations are applicable to both roles of employees in incidents of violence.

Criminal prosecution of individuals for workplace violence or threats is excluded from consideration in this chapter. The fact that such conduct has an employment connection...
