4. (§2.9) Intent

Logically, if marriage is based on consent, both parties must intend to marry in order to enter into a valid marriage relationship. Occasionally, one of the parties asserts that the marriage is invalid because one or the other party did not really intend to marry, to cohabit permanently with the other party, or that the marriage ceremony was a sham or performed in jest.
