1. (§2.6) In General

The first group of requirements is based on the consensual nature of marriage. Section 451.010, RSMo 2000, requires the consent of the parties as an essential element. Marriages have been attacked for lack of requisite consent in three major situations:

1. Fraud

2. Duress

3. The intent of the parties at the time of the marriage ceremony
