Section 2.55 Filing Claim With MPCIGA

Section 375.775.1(1)(a)a–d, RSMo Supp. 2003, establishes the procedures for filing claims with the MPCIGA. In the notice of claim, the claimant must include:

· particulars of the claim;

· a statement that the sum claimed is justly owed and no setoff, counterclaim, or defense to the claim exists;

· the name and address of the claimant and the claimant’s attorney, if any; and

· if the claimant is an insured, a statement that the insured’s net worth did not exceed $25 million on the date of the insurer’s insolvency.
