3. (§2.34) Custody From the Licensed Child-Placing Agency
It is important to remember that the prohibition of § 453.110.1, RSMo 2000, applies to agencies, organizations, and institutions as well as to private persons. Therefore, if custody of a child has been received by the petitioners through a licensed child-placing agency, the attorney should investigate to confirm that the agency has obtained lawful and actual custody of the child, either through a prior court order or by virtue of a valid child-placing agreement with the birth parents. State ex rel. Koehler v. Lewis, 844 S.W.2d 483 (Mo. App. W.D. 1992).
