XII. (§2.28) Compromise and Offers of Compromise

Generally, offers of compromise or settlement are to be excluded at trial. St. Louis Cnty. v. River Bend Estates Homeowners’ Ass’n, 408 S.W.3d 116, 128 (Mo. banc 2013) . Proof of compromise or settlement with a third party is not admissible to prove the validity or invalidity of a claim. State v. Kaiser, 139 S.W.3d 545, 559 (Mo. App. E.D. 2004) .
