B. (§2.2) What Is a Fiduciary?

A fiduciary relationship is created when there has been a special confidence reposed in someone who, in equity and good conscience, is bound to act in good faith and with due regard to the interests of the one reposing the confidence. McKeehan v. Wittels, 508 S.W.2d 277 (Mo. App. E.D. 1974). The Uniform Fiduciaries Law, §§ 469.240–469.350, RSMo Supp. 2005, defines “fiduciary” as including:
