4. (§2.13) Effect of Posttrial Motions in Court-Tried Cases
Rule: A timely posttrial motion in a court-tried case postpones finality for 90 days after the motion is filed or until the trial court decides the motion, whichever is earlier. A notice of appeal must be filed within 10 days thereafter.
Rule 73.01(d) permits, but does not require, a motion for new trial or a motion to amend the judgment in a court-tried case. Thus, in a court-tried case, a motion for new trial is not a prerequisite to preserving error on appeal.
