This chapter addresses the civil torts of assault and battery. While the torts of assault and battery are seldom mentioned independently, they are wholly separate and distinct torts, and this chapter deals with each separately. See A.R.B. v. Elkin, 98 S.W.3d 99, 104 (Mo. App. W.D. 2003). First, the tort of assault and its elements are examined. Second, battery is examined and discussed in detail.
