The terms of commercial leases vary widely, in part because of the:
many types of real property that may be subject to a lease; planned use of the property; specific needs of the landlord and the tenant; and relative bargaining power of the parties.
Before beginning work on a lease, counsel should gather as much information as possible, consider the various issues that need to be addressed, and prepare a checklist or study a similar lease. This preparation at the outset will enable counsel to ask the proper questions and to raise and discuss issues and options relating to the lease and the leasing transaction with the client.
