Section 19 Transfer on Death

Section 301.681, RSMo Supp. 2007, allows a motor vehicle owner or owners to designate a “transfer on death” (TOD) beneficiary on a title as long as the title is held by a sole owner, joint tenants, or tenants by the entirety. Tenants in common may not use this provision. Section 301.675, RSMo 2000, makes a presumption that all titles held in more than one name are held in joint tenancy unless tenancy in common is elected on the title application.
