E. (§19.28) Signature of Witness

After the witness’s testimony is transcribed, the deposition must be submitted by the officer to the witness (presentment). Rule 57.03(f). Most parties waive formal presentment. The witness is under an obligation to make any changes the witness desires and to then sign the deposition. Id. A witness’s signature may be waived by the parties or, if agreed, the deposition may be treated as signed if not signed by the date of trial. Id.
