A. (§19.24) Generally

Under Rule 57.03, the testimony of any person, including a party, may be taken by deposition upon oral examination. Leave of court is required if the petitioner seeks to take the deposition within 30 days after service of the petition and summons. Rule 57.03(a). But if the respondent initiates a deposition within the 30-day period, the petitioner is free to engage in early discovery.

Seven days’ written notice of the deposition is required to all parties. Rule 57.03(b)(1). Notice may be shortened by the court if appropriate. Rule 57.03(b)(2). See State v.
